Abstract

FOGASA ensure the wage claims of employees in case of employer’s insolvency. As it is a public institution and is not subject to criteria of profitability, it has led to improved welfare and has contributed to a more flexible labor market of small businesses. The Labor Reform of June 2010 will implement flexibility on the labor market. To do this, the Fogasa will be forced to subsidize dismissal in all companies including the unfair dismissal but disguised as a just objetive. This will lead to an abuse of the Fogasa wich would be one deficit and a rise in its price.
